It is important to know whether or not the court you have chosen to file your judgment or domesticate your judgment approves Turnover Orders.  Yes, in our experience, there are some courts that do not approve Turnover Orders due to the more aggressive collection options included in the order that are available to the Receiver.  A Turnover Order includes a number of collection methods that are currently not available to a normal collection agency or collection attorney.

Therefore, it is important that if you have a case that you would like to obtain a judgment, the documents should be filed in a court that will be agreeable to granting a Turnover Order, once the judgment has been obtained.  It is also important to realize that no matter where the debtor or debtors live in Texas, you can file in any court.  In our experience, there are certain courts who are more agreeable to granting turnover orders.  Filing the case in the right court will greatly impact the success of obtaining a turnover order and getting our recommended Receiver appointed.  The filing of a motion and order for turnover is the next step after obtaining a judgment.

Likewise, if you have a judgment that was obtained from another state (other than Texas), we can file the necessary paperwork (domesticate the judgment) in a court that historically approves turnover orders, thereby making it easier to obtain the turnover order once the judgment has been domesticated in Texas.  domesticating a judgment in the right court will greatly impact the success of obtaining a turnover order and getting our recommended Receiver appointed.
